Ministerial Decree No. 617/2024, issued by the Ministry of Labor on October 17, 2024, requires employers with 50 or more workers to establish a formal system for handling employee complaints and grievances. This decree, based on Labor Law issued by Royal Decree No. 53/2023, ensures that all employees have a clear process for resolving workplace concerns.
Employers must follow a structured approach when employees file complaints or grievances. First, the employee must submit their complaint to their direct supervisor, who is required to respond within two working days. If the supervisor does not respond or the response is not satisfactory, the employee can escalate the matter to the employer or a designated representative, who must address the complaint within five working days.
If the issue remains unresolved, the employee may seek resolution through the Ministry of Labor’s administrative division. This complaints and grievances system ensures employees have a formal process to raise concerns and seek solutions.
Employers are also required to provide employees with an approved copy of this system to ensure transparency and compliance. By following this decree, employers help foster a fair work environment and protect workers’ rights.
This decree took effect after its publication in the Official Gazette on October 20, 2024. Employers must act swiftly to comply with the complaints and grievances system to avoid violations.
